By downloading, installing, or using the GainsCoach mobile application (“App”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and GainsCoach / Elite Football Academy (“we,” “our,” or “us”), based in St. Louis, Missouri.
The App is intended for users age 9 and older. By using the App, you represent that:

All subscription plans include a 3-day free trial for new subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be charged.

Subscriptions are billed through Apple’s App Store and managed via Apple’s StoreKit platform. Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period — you will retain access through the end of the period you paid for. We do not offer refunds for partial subscription periods.
All purchases are processed by Apple. Refund requests must be submitted directly to Apple at reportaproblem.apple.com. We do not control Apple’s refund decisions.
You agree to use the App only for lawful purposes. You agree not to:

GainsCoach provides general performance nutrition guidance for athletes. The App is NOT a substitute for professional medical advice, diagnosis, or treatment. Always consult a physician, registered dietitian, or qualified healthcare provider before making significant changes to your diet or nutrition plan — especially if you have a medical condition.
Coach Gains is an AI persona, not a licensed nutritionist or medical professional. AI-generated meal suggestions and coaching messages are for informational and motivational purposes only. Individual results will vary.
All content within GainsCoach — including the Coach Gains persona, AI-generated coaching messages, the GainsCoach brand, design, code, and features — is owned by Elite Football Academy LLC or its licensors.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Food logs, weight entries, and personal data you submit remain yours. You grant us a license to use this data solely to operate and improve the App as described in our Privacy Policy.
GainsCoach is provided “as is” and “as available” without warranties of any kind. We do not warrant that the App will be uninterrupted or error-free, or that any specific results will be achieved. We are not responsible for the accuracy of AI-generated content, including meal suggestions, calorie estimates from food photos, or coaching messages.
To the maximum extent permitted by applicable law, Elite Football Academy LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of GainsCoach. Our total liability to you for any claims shall not exceed the amount you paid to us in the 12 months preceding the claim.
You may stop using GainsCoach at any time and delete your account from Profile → Settings → Delete Account. Account deletion is permanent and irreversible.
We may suspend or terminate your access if you violate these Terms or for legal compliance reasons. If we terminate your account without cause, we will refund any prepaid subscription fees on a pro-rated basis.
These Terms are governed by the laws of the State of Missouri, United States. Any disputes arising from these Terms shall be resolved in the courts of St. Louis County, Missouri.
GainsCoach is distributed through the Apple App Store. Apple is not a party to these Terms and has no obligation to provide maintenance or support for GainsCoach. Apple is not responsible for any claims related to GainsCoach, including product liability or consumer protection claims. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the above.
By using GainsCoach, you also agree to Apple’s standard End User License Agreement (EULA), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
We may update these Terms as the App evolves. When we make material changes, we will notify you via in-app notification or email. Continued use of GainsCoach after changes take effect constitutes your acceptance of the revised Terms.
